What this site is, what it is not, and the rules for using it.
1. About these terms
This website is operated by David Albert, operating as David Albert, based in Ontario, Canada. Using the site means you accept these terms. If you do not accept them, please do not use the site.
2. What this website is
This site describes David Albert's consulting work and offers two ways to get in touch: a consultation form and a booking link. That is its entire function.
It does not sell anything, take payment, host an account area or deliver a service. Nothing on it is an offer capable of acceptance, and submitting the form does not create a consulting engagement. An engagement begins only when it is agreed separately in writing.
3. The information on this site is general
Everything published here is general commentary on business, brand and revenue, written for a broad audience. It is not advice for your particular business, and it is not legal, accounting, tax, financial or investment advice.
Consulting advice is only advice when it is given to you directly, about your business, with your circumstances in front of him. Acting on general website content is your own decision.
4. Results
No specific outcome, revenue figure, growth rate or result is promised, guaranteed or implied anywhere on this site. Any results described are particular to those situations and are not a prediction of what would happen in yours.
References to years of experience and number of brands worked with describe David Albert's professional background. They are not a warranty of future performance.
5. Testimonials
Where testimonials appear, they are the honest opinions of the people named. They reflect those individuals' experience and are not a guarantee that anyone else will have the same experience.
6. Intellectual property
All content on this site, including the text, layout, design, graphics, photographs and the David Albert name and marks, is owned by David Albert or used with permission, and is protected by Canadian and international copyright law.
You may read the site, and share a link to it, freely. You may not copy, reproduce, republish, adapt or use the content commercially, or pass any of it off as your own, without written permission.
Quoting a short passage with clear attribution and a link back is fine and welcome.
7. Your responsibilities
When you use this site or its form, you agree to:
- Give accurate information about yourself and your business
- Not submit anything unlawful, abusive, defamatory or deliberately misleading
- Not use the form for spam, solicitation, recruitment or bulk marketing
- Not attempt to gain unauthorised access to the site or any connected system
- Not introduce malicious code, scrape content at scale, or interfere with the site's operation
- Not use automated means to submit the form
Access may be refused or blocked where any of the above occurs.
8. Confidentiality of what you send
Enquiry details are treated as confidential and are used only to respond to you. Please do not send financial records, identity documents, trade secrets or anything you would not put in an ordinary email. The form is a first contact, not a secure document channel.
9. Third-party links and services
This site links to external services including LinkedIn, Calendly and WhatsApp. Those are independent services with their own terms and privacy practices. No responsibility is accepted for their content, availability or conduct, and a link is not an endorsement.
10. Availability
Reasonable effort is made to keep the site available and accurate, but it is provided on an "as is" and "as available" basis. It may be unavailable during maintenance, outages or events outside anyone's control, and it may be changed, suspended or withdrawn at any time without notice.
11. Limitation of liability
To the fullest extent permitted by law, David Albert is not liable for any indirect, incidental, special, consequential or punitive loss, or any loss of profit, revenue, data, goodwill or business opportunity, arising from your use of this website or from reliance on anything published on it.
Nothing in these terms limits liability for fraud, fraudulent misrepresentation, or anything else that cannot be limited under applicable Canadian law.
Liability under a paid consulting engagement is governed by the agreement for that engagement, not by this page.
12. Privacy
How personal information is handled is set out in the Privacy Policy, which forms part of these terms.
13. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes are subject to the exclusive jurisdiction of the courts of Ontario.
14. Changes to these terms
These terms may be updated from time to time. The date at the top shows the current version, and continuing to use the site after a change means you accept it.
